and conditions of Freedom Federal Credit Union’s Internet Service Electronic
Funds Transfer Disclosure and Agreement ( “FreeNet 24 Account Access Agreement” or “Agreement” )
below. Once you agree to the terms and conditions as outlined in this Agreement,
you can request your FreeNet 24 user ID and Password by clicking the “I ACCEPT” button on the last page
and proceeding to Enrollment.
Please read this disclosure carefully and print
it for your records. If you are unable to print this document, a copy can be provided to you by Freedom upon
request.
The FreeNet 24 Account Access Agreement, as amended
from time to time, sets forth the terms and conditions governing
the use of Freedom Federal Credit Union's FreeNet 24 "Internet
Account Access" and "eBill Payer" services (collectively "FreeNet
24"). Disclosure information that applies to "Internet Account
Access" and "eBill Payer" services offered by Freedom Federal
Credit Union is given below. By using, or allowing another
person to use, FreeNet 24 Internet Account Access and eBill
Payer services, you are agreeing to be bound by the terms and
conditions of this Agreement. In this Agreement, the terms "you" and "your(s)" refer
to the member, and the terms "we", "us", "our(s) "FFCU” and "Freedom" refer
to Freedom Federal Credit Union. All agreements and disclosures
shall be construed in accordance with the provisions of the
Uniform Commercial Code (UCC). This Agreement is incorporated
by this reference into, and becomes a part of, the Freedom
Federal Credit Union's Electronic Funds Transfer Disclosure
and Agreement effective January 1, 2001. All other terms and
conditions of your Electronic Funds Transfer Disclosure
and Agreement, as amended, remain in force.
1. Required Equipment
To use FreeNet 24 Account Access and eBill Payer,
you need a personal computer equipped with a modem and Web
browser. FreeNet 24 requires the use of Netscape 4.70 or greater,
or Microsoft Internet Explorer 5.0 or greater. You understand
Freedom does not make any warranties regarding equipment, hardware,
software or Internet Service Provider service, or any part
of them, expressed or implied, including, without limitation,
any warranties of merchant ability or fitness for a particular
purpose. Freedom is not responsible for any loss, injury, or
damages, whether direct, indirect, special or consequential,
caused by your chosen Internet Service Provider, any related
software, or the use of any of them, or arising in any way
out of the installation, use or maintenance of your personal
computer hardware, software, files or other equipment.
Your Membership and Deposit Account Agreement with
the Freedom is incorporated into this Agreement and Disclosure
by reference.
2. Enrollment
To use FreeNet 24 you must have a membership
in good standing with Freedom Federal Credit Union in addition
to your confidentially assigned FreeNet 24 user ID and Password.
You can apply for FreeNet 24 account access by
visiting Freedom’s web site at www.freedomfcu.com and clicking
on the FreeNet 24 icon. After agreeing to the terms and
conditions of the FreeNet 24 service, you will then proceed
to the Enrollment page where you can authorize the issuance
of your user ID and Password via e-mail.
Your FreeNet 24 user ID and Password also allow
you access to Freedom’s eBill Payer service. You must
have a user ID, a Password, and a Freedom checking account
in good standing to use the eBill Payer program. Bills
may not be paid from any non-checking account type.
3. Electronic Provision of the FreeNet 24 Internet
Service
Electronic Funds Transfer Disclosure and Agreement
By accessing the FreeNet 24 Internet services,
you acknowledge electronic receipt of the Freedom Federal Credit
Union's Internet Service Electronic Funds Transfer Disclosure
and Agreement. You agree that you have read this Agreement
in its entirety and will abide by its terms and conditions.
You understand that Freedom will not provide you with an additional
paper copy
of this Agreement unless you specifically request
it.
4. Who is Bound by this Agreement
Each person ("user") who uses the FreeNet 24 Account
Access and eBill Payer, or enters a FreeNet 24 user ID code
and Password agrees to be bound by the terms and conditions
of this Agreement. If more than one user per user ID / Password
utilizes the FreeNet 24 service, all such users are jointly
and severally liable. Freedom can waive or delay enforcement
of its rights as to one user without affecting its ability
to enforce its rights as to the other user(s). The Agreement
is also binding upon your heirs, personal representatives,
successors and anyone to whom you grant FreeNet 24 access to
your account by giving them your confidential FreeNet 24 user
ID and Password.
5. Right to Receive Documentation of Transactions
You will receive an account statement reflecting
all of your transactions. In any case you will receive
a statement at least quarterly.
6. Your Liability for Unauthorized Transactions
Keep your confidential user ID and Password safe. Do
not leave them where others can find them and use them to make
unauthorized transactions on your account.
Tell us AT ONCE if you believe your user ID and
Password have been lost or stolen. Telephoning is the best
way of minimizing your possible losses. You could lose all
the money in your account. If you tell us within two (2) business
days, you can lose no more than $50.00 if someone used your
user ID and Password without your permission.
If you DO NOT tell us within two (2) business
days after you learn of the loss or theft of your user ID and
Password, and we can prove that we could have stopped someone
from using your them without your permission if you had told
us, you could lose as much as $500.00. If you have authorized
someone else to use the user ID and Password, you are responsible
for all transactions which that person or persons initiates
at any time, even if the aggregate value of the transactions
exceeds what you may have authorized.
Also, if your statement shows transactions that
you did not make, tell us at once. If you do not tell us within
60 days after the statement was mailed to you, you may not
get back any money you lost after the 60 days if we can prove
that we could have stopped someone from taking the money if
you had told us in time. If a good reason (such as a long trip
or hospital stay) kept you from telling us,
we may extend the time periods.
7. How to Notify Freedom in the Event of an
Unauthorized Transaction
If you believe your user ID and Password have
been lost or stolen or someone has transferred or may transfer
money from your account without your permission, call us at
252-442-8888, or write to us at P. O. Box 2703, Rocky Mount,
North Carolina 27802.
8. Business Days
For purposes of these disclosures,
our business days are Monday through Friday excluding
holidays. 9. User ID and Password
Your user ID and Password for FreeNet 24 Access
Account and eBill Payer are your confidentially assigned FreeNet
24 codes. We strongly suggest you change your Password
(click on the My Preferences icon) upon entrance to FreeNet
24 the first time. If you forget your user ID or Password,
contact Freedom and we will issue you new ones.
10. Charges
FreeNet 24 Account Access is FREE to all members. FreeNet
24 eBill Payer is $0.00 monthly and allows the payment of an unlimited number of bills.
11. Disclosure of Account Information to Third Parties
We will disclose information to third parties
about your account or transfers you make:
a) When it is necessary to complete
the transaction;
b) in order to verify the existence and
condition of your account for a third party, such as a credit
bureau or merchant;
c) in order to comply with government agency
or court orders or other legal process; or
d) if you give us your prior oral or written
permission.
12. Address Change
You are required to keep Freedom Federal Credit
Union informed of your current address to insure correct
mailing of account statements.
13. Amendments
Freedom may change the terms and conditions
of this Agreement from time to time by posting the amended
Agreement on our public web site. It is your responsibility
to review this Agreement periodically to monitor changes
and you agree to do so. If any change results in greater
cost or liability to you or decreases access to your accounts,
this change will be posted to our public web site at least
21 days in advance of its implementation. Prior notice may
not be given where an immediate change in terms or conditions
is necessary to maintain the integrity of the system and/or
the security of our Internet Services or designated accounts.
14. Termination
You may terminate this Agreement with us at
any time. Freedom reserves the right to terminate this Agreement
and/or your use of FreeNet 24 with or without cause. We may
do so immediately if:
a. you or any authorized user of your account
breaches this or any other agreement with Freedom;
b. we have reason to believe that there
has been or might be an unauthorized use of your account; or
c. you or any authorized user of your account
requests that we do so.
15. Collection Costs
You agree to pay Freedom Federal Credit Union
for reasonable expenses, including court costs and attorneys’ fees, for enforcing our rights
under this Agreement.
16. Additional Benefit Enhancements
Freedom may from time to time offer additional
services to you in connection with your accounts. Some services
may be at no additional cost to you and others may involve
a specified fee. You understand that Freedom is not obligated
to
offer such services and may withdraw or change
them at any time.
17. Reservation of Rights
Failure or delay by Freedom to enforce any provision
of this Agreement or to exercise any right or remedy available
under this Agreement, or at law, shall not be deemed a waiver
and Freedom expressly reserves the right to enforce such
provision,
or to exercise such right or remedy, at a later
date.
18. Our Liability for Failure to Make Transfers
If we do not complete a transaction to or from
your accounts on time or in the correct amount according
to our agreement with you, we will be liable for your losses
or damages. However, there are some exceptions. We will NOT
be liable, for instance, if:
a. Through no fault of ours, you do not
have enough money in your account to make the transaction,
b. The network system was not working properly
and you were aware of the malfunction when you started the transaction,
c. Circumstances beyond our control (such
as fire, flood, power failure, or computer down-time) prevented
the transactions despite reasonable precautions that we have
taken,
d. The money in your account is subject
to an uncollected funds hold, legal process or any other encumbrance or agreement restricting a transaction,
e. Your user ID and / or Password has /
have been entered incorrectly,
f. The payee mishandles or delays a payment
sent by our eBill Payer service provider,
g. You have not provided our eBill Payer
service provider with the correct names, phone numbers,
or account information for those persons or entities
to whom you wish to direct pay, or
h. The failure to complete the transaction
is done to protect the integrity of the system or to protect
the security of your account.
There may be other exceptions not specifically
mentioned above.
Additional Disclosures Applicable to FreeNet 24’s "e Bill
Payer" Service
1. FreeNet 24’s "Electronic Bill Payer" Service Limitations
The following are limitations to the use of
FreeNet 24’s eBill Payer Service:
a. eBill Payments can only be made from
your designated Freedom checking account.
b. Payments cannot be made for tax payments,
court-ordered payments or payments to payees outside of the United
States.
c. If you close the designated eBill Payer
checking account, all scheduled payments will be stopped;
d. You cannot stop a payment if the payment
has already been processed.
e. You can schedule payments 24 hours a
day, seven days a week, however, no payments will be processed on a Saturday, Sunday, or holiday.
2. Duty and Liability Limitations
As a general matter, Freedom and our third-party
eBill Payer service provider are responsible for the consequences
of our errors or negligence. Neither of us, however,
are required by this Agreement to detect or correct erroneous
information entered by you and neither of us has any liability
for following instructions issued by you. Additionally,
neither Freedom nor our eBill Payer service provider have
any liability for acts of fraud committed by persons other
than our respective employees with regard to any account
maintained by you. We agree to use our best efforts
to maintain a secured and encrypted electronic bill payment
site; however, we will not be liable for any breaks in security
which occur as a result of the actions of unauthorized third
parties … nor will we be liable for any damages that result from such
actions.
3. eBill Payer Returns/Overdrafts
Your Electronic Bill Payment activities will
be subject to fees as disclosed in our Fees and Charges schedule
published from time to time. You also agree that an NSF fee
may be charged to your account even if the payment is not
returned but is paid and overdraws your payment account.
4. Electronic Bill Payment Methods and Restrictions
Payments are made to your payee either electronically
via the Automated Clearing House (ACH) or by paper check.
The method of payment depends upon the processing method
that can be accommodated by your payee or by our eBill Payer
service provider. It is important that you take into consideration
what payment method will be used when scheduling eBill payments
to ensure payment deadlines are met. After scheduling a payment
due date, be sure to check your file for the calculated draft
date. Payments will be drafted from your specified checking
account 5 business days prior to the scheduled due date.
5. Timing Requirements for FreeNet 24 eBill
Payer
If you schedule a payment to occur on a date
that falls on a Saturday, Sunday or holiday, the payment
will be issued the first business day after the Saturday,
Sunday or holiday.
Payments generally take three to six working
days after your scheduled draft date to reach the recipient,
depending on whether the payee accepts electronic payments
or requires a paper check.
Please allow adequate time for your payment
to reach the payee by the payment due date.
Payments and transfers will be processed if
sufficient funds are available to perform the transaction
on the draft date. If funds are not available when
Freedom opens for business on the draft date, the payment
/ transfer will not be funded … and will not be attempted at a later date.
6. Electronic Bill Payment Service Responsibilities
You are responsible for:
a. Any late payment or service fees charged
by payee(s) and any overdraft, NSF or stop payment fees charged
by Freedom as a result of these transactions;
b. data input of payee information (payment
amount(s), name, address, account number and any other pertinent
information); and
c. written notification to Freedom in the
event you wish to cancel this service.
Right to Stop Payment of Pre-authorized Transfers,
Right to Receive Notice of Varying Amounts, and Our Liability
for Failure to Stop
A. Right to stop Payment and procedure
for doing so.
If you have told us in advance to make regular
(recurring) payments out of your account, you can also stop any of these payments on line
through our eBill Payer Service.
B. Notice of varying amounts.
You may vary the amounts of your regular (recurring)
by using Schedule Payments facility to do so.
C. Liability for failure to stop Payment
of pre-authorized transfers.
If you order us to stop one of these payments three
(3) business days or more before the transfer / draft date, and we do not do so, we will be liable to you for
the amount of the payment.
7. eBill Payer Monthly Service Fee
The eBill Payer monthly fee of
$0.00 will be
charged to your checking account on the last business day
of each month.
This fee allows you to pay an unlimited number
of bills electronically.
8. Changes in Terms
Freedom may change the terms and conditions
of this Agreement from time to time by posting the amended
Agreement on our public web site. It is your responsibility
to review this agreement periodically to monitor changes
and you agree to do so. If any change results in greater
cost or liability to you or decreases access to your accounts,
this change will be posted to our public web site at least
21 days in advance of it’s implementation. Prior notice may
not be given where an immediate change in terms or conditions
is necessary to maintain the integrity of the system and
/ or the security of our Internet Services or designated
accounts. You agree that we may immediately terminate this
Agreement and your use of electronic fund transfer services
without prior notice if any of the following occur:
a. If you (or any authorized user of
your account) breach this or any other agreement between
us.
b. If we have reason to believe that there
has been or may be an unauthorized user of your accounts.
c. If there are conflicting claims to the
funds.
d. If you or any authorized signer on your
account asks us to do so.
e. If you complete a transaction at a time
when funds are not available in your Freedom accounts accessed
under this program.
9. Collection Expenses
If Freedom has to take legal action to
collect what you owe us, you agree to pay Freedom's expenses,
including attorneys' fees, as may be determined by the court.
You will pay our attorney's fees and court costs whether
we incur them in a collection lawsuit, a bankruptcy proceeding,
an appeal, a proceeding to enforce a judgment we have against
you, or otherwise. You also agree to pay reasonable collection
costs we incur before suit is filed. You agree that Freedom
shall be entitled to recover any money you owe us as a result
of EFT services such as FreeNet 24 Account Access and eBill
Payer, including but not limited to amounts by which your
accounts are overdrawn. Freedom has a security interest in
your present and future shares and has the right to apply
shares or deposits to reduce any money you owe us in full
or in part. You agree that if we exercise this security interest,
we have not waived any other rights we have against you.
10. In Case of Errors or Questions About Your Electronic
Transfers
If you think that an electronic transfer shown
on your statement is wrong, or if you need more information
about a transfer,

We must hear from you no later than 60 days
after we sent you the FIRST statement on which the error
or problem appeared.
When you call or write to us in this regard, you
should:
a. Tell us your name, your account number,
and your phone number.
b. Describe the error or the transfer about
which you are unsure and explain as clearly as you can why you
believe it is an error or why you need more information.
c. Tell us the dollar amount of this suspected
error and the date of the transaction as shown on your statement.
If you tell us orally, we may require
that you send us your complaint or question in writing within
10 business days.
1. We will tell you the results of our
investigations within 10 business days after we hear from
you and will correct any error promptly.
If we need more time, however, we may take up to
45 days to investigate your complaint or question. If we decide
to do this, we will re-credit your account within 10 business
days for the amount you think is in error, so that you will have
the use of the
money during the time it takes us to complete our
investigation. If we ask you to put your complaint or question
in writing and we do not receive it within 10 business days,
we may not credit your account.
2. If we decide that there
was no error, we will send you a written explanation within 3
business days after we finish our investigation.
You may ask for copies of the documents that we
used in our investigation.
